Wife/Teacher Didn’t Report Husband/Teacher’s Abuse of Student – And School’s Facing Trial

Anti-nepotism policies make it a workplace rule that employees can’t be married to each other.

A Delaware private school didn’t have one. A former student has sued it, alleging a male teacher sexually abused her and his wife knew about the abuse – but didn’t report it.

Should Have Foreseen Conflict

A state appeals court has reversed a trial court’s decision to dismiss the case on the ground that marital loyalty took the wife’s decision out of the sphere of her employment.

Instead, the appeals court held a Delaware school’s decision to hire employees who might face a conflict between their relationship and their duty to protect students is a factor a state jury can consider in deciding if the school was negligent.
